The 13-year-old boy was forced to live in a dog kennel and wear diapers before he was raped and seriously burned, then beaten to death and buried along the road.
Jeremiah Valencia lived in a plastic booth in the yard and wore adult diapers as a punishment, prosecutors say. The boy’s body was found shallowly buried on the side of the road in January of this year, says Mirror.
His mother's boyfriend, Thomas Ferguson, is charged with murder. An autopsy revealed that the teenager was buried in a diaper, with numerous cuts and wounds to the body, which experts attributed to sexual abuse.
His mother, 35-year-old Tracy Ann Peña and her boyfriend, 42-year-old Thomas Wayne Ferguson, and 19-year-old son of Ferguson Jordan Nunez will be brought to trial in connection with Jeremiah’s death. 13-year-old sister of the murdered boy said that Ferguson repeatedly scoffed at Jeremiah and beat him to death in late November.
The body of the murdered teenager was discovered after a prisoner in the Santa Fe County Prison told law enforcement officers that Peña told her about her son’s death. Peña told investigators that she had to help Ferguson to move the boy’s remains to the grave, and said she was silent for fear of her boyfriend.
Núñez and Peña are accused of child abuse, which led to the death of the child, falsification of evidence and conspiracy to deceive the investigation. Ferguson was convicted last week by a grand jury of first-degree murder and received another 17 criminal charge, including kidnapping, child abuse and falsification of evidence.
