A Moscow court dismissed the lawsuit against Bari Alibasov against the manufacturer Krot, which allegedly poisoned the producer on 4 this June, as a result of which he was urgently hospitalized. Alibasov announced his intention to appeal the decision of the court in higher instances.
The Presnensky court of Moscow rejected the lawsuit of music producer Bari Alibasov against the manufacturer of Krot pipe cleaning tools, Auchan hypermarket where the funds were purchased, and Ingosstrakh insurance company, as Auchan's liability was insured in it. The musician demanded to recover 100 million rubles (1,5 million dollars), writes Newspaper.ru.
“The civil lawsuit in Alibasov’s interests should not be satisfied,” Judge Anna Karpova announced the decision.
However, it did not enter into legal force, since Alibasov’s defense stated that it intended to appeal the court’s decision. The music producer himself said that he was not upset by this outcome of the proceedings and intends to achieve his goal.
“We will sue the higher authorities, of course! - quotes the words of Alibasov RIA "Novosti". - First of all, you still need to give people useful lessons so that they do not give up. The same court of first instance rejected, so we will continue to file a claim with the court of second instance. ”
The trial lasted two days. The defendants expected the Presnensky court to make a decision on the very first day, October 2, but Judge Karpova suggested postponing the hearing to October 8.
Alibasov’s main argument was that the manufacturer “Krota” violated the requirements of GOST for labeling and packaging. The producer refers to the fact that the color scheme of the product packaging makes it look like juice or lemonade, and the small print does not allow people with poor eyesight to read what is in the bottle.
The manufacturer of the cleaning agent, in turn, attached the protocol of an outpatient test of the goods to the case. As for the position of Auchan hypermarket, its representatives categorically refused to recognize Alibasov’s claims on the first day of the hearing.

Auchan sells thousands, if not millions, of goods. We have knives for sale. But this does not mean that if a consumer injures someone with a knife, Auchan will become a violator, ”the company’s lawyer said in court.
Nevertheless, if Alibasov appeals the decision of the Presnensky court of Moscow and goes to higher instances, then testimonies of the witnesses and a report on the research work on the subject of the disputed goods will be added to the case. In the meantime, the producer will again collect evidence in his case.
A scandal with Alibasov and pipe cleaning fluid broke out on June 4 of this year. The musician was urgently hospitalized at the Sklifosovsky Institute, mistakenly drinking the notorious drug, which he confused with juice. It was reported that doctors began pumping out the artist right in the ambulance near his house in Merzlyakovsky Lane.

A representative of Alibasov said that the producer was diagnosed with a fourth degree of stomach burn, after which he was introduced into an artificial coma. However, already during his stay at the Sklifosovsky Research Institute, what was happening around Alibasov’s person began to suggest to many that his condition was not so difficult, and that the whole story was just part of a big PR campaign.
First, information appeared about the loss of the musician’s cat, nicknamed Chuch, who was later allegedly successfully found, having paid the finder a large monetary reward. The very next day, a representative of Alibasov said that it was not that cat, but found the present later.
The most suspicion was caused by the fact that Alibasov was discharged from the hospital on June 17 - 13 days after hospitalization. As many medical experts noted in the media, with a fourth degree chemical burn, patients are not discharged so soon.
The public finally disbelieved what was happening after a series of programs on central television channels in which Alibasov was too picturesque and openly replaying - his behavior on the programs of Dmitry Borisov and Andrei Malakhov caused a lot of negative comments on the network.
